Sprint See What I’m Saying Contest

Official Rules

No Purchase Required to Enter or Win

1.                  Eligibility:  The Sprint See What I’m Saying Contest (the “Contest”) is open to participants worldwide. Employees of Sprint Communications Company, LP or Worldplay, Inc., as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.  The Contest is subject to federal, state, and local laws and regulations and is void where prohibited by law.

2.                  Sponsor: The Contest is sponsored by Sprint Communications Company, LP, 6200 Sprint Parkway, Overland Park, KS 66251. (the “Sponsor”).

3.                  Agreement to Official Rules: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

4.                  Entry Period: The Contest begins at 12:00 A.M. PST on 09/15/10, and ends at 12:00 A.M. PST on 1/06/11, (the “Entry Period”). Entries submitted prior to or after the Entry Period will be disqualified.

5.                  How to Enter: During the Entry Period, visit www.seewhatimsayingmovie.com (the “Website”), complete the online entry form, and submit an entry that addresses the topic in one of the Categories set forth below (the “Entry”). Your Entry must include the following:

a. Must be fully captioned in English.

This includes any spoken or signed dialogue so that the films are fully accessible for deaf, hearing and hard of hearing audiences. Films without dialogue do not need to be captioned.

 

B. Must include the line: “See what I’m saying” in sign language, spoken dialogue, captioned, written or used as a tag line. Be creative!

 

C. Short film can be any length up to 3 minutes, but must not go over 3 minutes.

 

D. Must include Sprint logo on black card at the front of the film for at least 3 seconds. The Sprint logo may be downloaded from the Website.

 

E. Films must be family friendly and not contain any profanity, nudity or adult situations.

 

F. No other brands or product placement permitted other than Sprint Relay and/or “See What I’m Saying.”

 

G. No other music other than “See What I’m Saying” by Powder or music that you own the rights to may be used.

 

H. If music other than “See What I’m Saying” by Powder is used, you must own all of the performance, master, synchronization and mechanical rights and submit signed licenses upon request;

 

I. You can enter as many films as you want – you may even win multiple prizes.

 

J. The film with the most audience votes on January 5, 2011 wins. The film with the second highest number of votes on January 5, 2011 is the second place winner. The See What I’m Saying Award will be selected by a professional team of judges and announced by February 2011.

 

    1. Requirements for Entries: Entries may not contain any copyrighted elements other than elements owned by the entrant.  Any elements that appear in the Entry, including, without limitation, images, music (other than “See What I’m Saying” by Powder,) audio, speech, or other audiovisual materials used must be entirely original, created and performed by the entrant, or be in the public domain.  Use of any elements that are not original or in the public domain will result in disqualification of an Entry at the Sponsor’s sole discretion.

6.                  Entrant’s Representations: By submitting an Entry, you represent that (a) you are the creator of the Entry, (b) the Entry does not infringe the rights of any third party, (c) the Entry has not previously been entered in any other contest, and (d) the Entry has not been previously published in any medium.

7.                  Sponsor’s Rights to Entries: By submitting an Entry, you grant the Sponsor the unconditional and perpetual right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the Entry (with or without using the your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.  By submitting an Entry, you further agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor, or any other person, on the grounds that any use of the Entry, or any derivative works, infringe any of your rights, including, without limitation, copyrights, moral rights.  You further acknowledge that the Sponsor is in no way obligated to publish or use your Entry in any way.  Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and the Sponsor.  In no way are you to be construed as the agent or to be acting as the agent of the Sponsor.

8.                  Selection of Potential Winners: Entries will be posted on the Website and visitors will be allowed to rate each Entry.  Visitors will only be allowed to rate an Entry one (1) time.  After the Entry Period, a panel of Judges selected by the Sponsor will evaluate the top ten (10) Entries in each Category according to the following criteria (the “Judging Criteria”): (a) Originality; (b) Accessibility; (c) Entertainment Value; and (d) Creative use of the line, “See What I’m Saying. The decisions of the Judges are final.  The odds of being selected as a winner depend on the relative performance of all entrants and the number of eligible entries received. In the event of a tie at any stage, the Judges will reevaluate each Entry involved in the tie according to the Judging Criteria.  The Sponsor will attempt to notify the potential winner within one (2) weeks of selection.

9.                  Requirements of Potential Winners: Except where prohibited, a potential winner will be required to complete and return an affidavit of eligibility and a release form (the “Affidavit/Release”) within seven (7) days of being notified.  If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place according to the Judging Criteria.  If a potential winner is a minor, his/her parent or legal guardian will be required to sign the Affidavit/Release on the potential winner’s behalf.

10.              Category Prizes: The entrant with the highest score in each Category will receive the corresponding prize listed below.  Please see the “For all Prizes” section below for additional details.

    1. Grand Prize Audience Award will be awarded to the Entry with the most votes. Grand prize audience award winner will receive the following prizes:
  • The winning film will be screened at the VIP Hollywood SEE WHAT I’M SAYING DVD release party with all expenses paid (airfare, hotel) for the winner to attend.
  • The grand prize winning film will be screened at the Focus Film Festival in Chico, CA for the public.
  • The winning film will be featured on the SEE WHAT I’M SAYING and Sprint Relay websites.
  • A VIP Hollywood industry meeting (interpreter provided if needed).
  • Sprint BlackBerry® phone (does not include service. Activation fee and monthly charges must be covered by the recipient).
  • Dell™ Mini Netbook computer.

 

    1. 2nd PLACE AUDIENCE AWARD – will be awarded to the Entry with the second (2nd) highest number of votes. The 2nd Place Audience Award Winner will receive the following prizes:
  • The 2nd place film will be screened at the VIP Hollywood SEE WHAT I’M SAYING DVD release party with all expenses paid (airfare, hotel) for the winner to attend.
  • The 2nd place winning film will be featured on the See What I’m Saying website.
  • A VIP Hollywood industry meeting (interpreter provided if needed).
  • Sprint BlackBerry® phone (does not include service. Activation fee and monthly charges must be covered by the recipient).

 

    1. SEE WHAT I’M SAYING AWARD will be selected by a panel of Judges based on the following the following criteria (the “Judging Criteria”): (a) Originality; (b) Accessibility; (c) Entertainment Value; and (d) Creative use of the line, “See What I’m Saying. The SEE WHAT I’M SAYING AWARD will receive the following prizes:
  • The winning film will be screened at the VIP Hollywood SEE WHAT I’M SAYING DVD release party with all expenses paid for the winner to attend.
  • The 2nd place film will be screened at the Focus Film Festival in Chico, CA for the public.
  • Your short film will be featured on the See What I’m Saying website.
  • A VIP Hollywood industry meeting (interpreter provided if needed).
  • Sprint BlackBerry® phone (does not include service. Activation fee and monthly charges must be covered by the recipient).

 

11.              For all Prizes: Any prize details not specified above will be determined by the Sponsor in its sole discretion.  Prizes are not transferable or refundable and must be accepted as awarded.  No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion.  The winner is responsible for any and all other costs and expenses not listed above including, but not limited to, wireless service and travel to events.  Prizes will be reported as income to a winner and the winner will be responsible for all taxes associated with the receipt of a prize.

12.              General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize according to the Judging Criteria from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the participant.  The “authorized account holder” is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

13.              Release and Limitations of Liability: By participating in the Contest, entrants agree to release and hold harmless the Sponsor, its parent and related companies, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize.  Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

14.              Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kansas.

15.              Contest Results: Winners will be posted on the Website.
